Report on the foundering of fishing vessel Fay LEYU/9827619 northeast of Honningsvåg 28 December 2019

Fay was line fishing north of Honningsvåg with a crew of twelve on board. The vessel foundered as a result of flooding of the line equipment room and gradual ingress of water to the rest of the vessel. The crew was rescued. During the process of setting a new line a power failure occurred, and it was not possible to close the setting hatch locally in a dead ship situation. Emergency closing was not activated from the wheelhouse. The investigation showed that the approved stability calculations for 'Fay' did not meet the stability requirements.
The situation during the accident did not give the crew any opportunity for emergency closing of the setting hatch, and it had to be closed from the wheel house. The NSIA finds that if the setting hatch had been closed at an early stage the fishing vessel would not have foundered.
Neither the setting hatch in the line equipment room nor the hatches in the hauling room were reckoned to be points of flooding, and the related volumes were therefore not deducted from the buoyancy volume.
The NSIA finds that, given the way she was put into operation, it would not have been possible to operate the vessel in compliance with the Regulations on Fishing Vessels of 15 m LOA and over.
NSIA believes that the accident also shows that the barriers to prevent stability calculations that do not meet the regulatory requirements are too weak.
The NSIA submits a total of nine safety recommendations as a result of the investigation.

Safety recommendation MARINE No 2021/01T
'Fay' foundered on 28 December 2019 as a result of flooding of the line equipment room and gradual ingress of water to the rest of the vessel. The approved stability calculations for 'Fay' did not meet the stability requirements set out in the Regulations on Fishing Vessels of 15 m LOA and upwards. The investigation has shown that it is insufficiently clear how volumes connected to flooding points are to be addressed in the stability calculations; see Section 1-2(18) and Section 3-2(1) point 1.
The Norwegian Safety Investigation Authority recommends that the Norwegian Maritime Authority take steps to clarify when volumes connected to flooding points are to be deducted from the buoyancy volume in the vessel's stability calculations.
Safety recommendation MARINE No 2021/02T
The accident with 'Fay' on 28 December 2019 revealed that Seacon AS had not performed the stability calculations correctly in that the relevant volumes were not deducted from the buoyancy volume at angles of flooding of less than 40 degrees. The fishing vessel foundered as a result of flooding of the baiting room and gradual ingress of water to the rest of the vessel.
The Norwegian Safety Investigation Authority recommends that Seacon AS uncover and repair corresponding faults in existing vessels of their design.

The accident with 'Fay' on 28 December 2019 showed that the Norwegian Maritime Authority's control procedures had not uncovered the failure to remove the baiting room from the buoyancy volumes at flooding angles of less than 40 degrees. The fishing vessel foundered as a result of flooding of the baiting room and gradual ingress of water to the rest of the vessel. The approved stability calculations for 'Fay' did not meet the stability requirements set out in Section 1-2(18) and Section 3-2(1) point 1 of the Regulations on Fishing Vessels of 15 m LOA and upwards.
The Norwegian Safety Investigation Authority recommends that the Norwegian Maritime Authority identify other vessels having corresponding faults, and ensure that such faults are repaired.
Safety recommendation MARINE No 2021/05T
'Fay' foundered 28 December 2019 as a result of flooding of the baiting room and gradual ingress of water to the rest of the vessel. There are currently no requirements that apply to undertakings that perform stability calculations, and the Norwegian Maritime Authority does not conduct any detailed reviews of such calculations.
The Norwegian Safety Investigation Authority recommends that the Norwegian Maritime Authority establish stronger barriers to ensure that stability calculations are performed in accordance with applicable regulatory requirements.

The local solution for closing hatches in an emergency did not meet the requirements set out in Section 2-16 of the Regulations on Fishing Vessels of 15 m LOA and upwards. The investigation has shown that the procedure for emergency closing of the setting hatch in a dead ship situation would have taken more than 15 seconds and required tools.
The Norwegian Safety Investigation Authority recommends that the shipyard Stadyard AS identify corresponding emergency closing solutions in vessels built by Stadyard AS, and cooperate with the owner to remedy any nonconformities with regulatory requirements.

The Norwegian Safety Investigation Authority recommends that the shipyard Stadyard AS establish better procedures for ensuring that future emergency closing systems meet applicable regulatory requirements.

The Norwegian Safety Investigation Authority recommends that the Norwegian Maritime Authority determine the extent to which this is the case and inspect any existing vessels with similar local solutions for emergency closing that do not meet the regulatory requirements.
Safety recommendation MARINE No 2021/09T
'Fay' foundered on 28 December 2019 as a result of flooding of the line equipment room and gradual ingress of water to the rest of the vessel through the freezer door into the bait room. The investigation has shown that the door did not meet the requirements for weathertightness set out in Section 2-4 of the Regulations on Fishing Vessels of 15 m LOA and upwards.
The Norwegian Safety Investigation Authority recommends that Stadyard AS cooperate with the owner to make repairs to any existing vessels built by Stadyard AS with similar doors that do not meet the regulatory requirements.
